Why Refugee Claims Fail

A poorly drafted Basis of Claim creates problems that cannot be corrected at the hearing. The tribunal has already read it. It has already formed the questions it will ask. The hearing is not a fresh start. It is an examination of what was already filed.

The earlier preparation begins, the stronger the Basis of Claim and the better the evidence package.

Most refugee claims that are denied are denied on credibility. In almost every case, the problems that produced that finding were present in the file long before the hearing. By the time they become visible, they are very difficult to address. I find them before that point.
I know what inconsistencies look like to an officer, because I have seen what they cost. The problems that damage credibility are rarely the ones claimants are aware of. They are the ones that only become visible to someone who has reviewed many of these files and knows exactly what to look for.
A refugee hearing is a formal legal proceeding. Being unprepared for it is not something that can be corrected once it begins. The claimants I have seen struggle in the hearing room were not lying. They were not ready for how the questions were asked and what the room required of them.
What produces a negative credibility finding is rarely what the claimant expected. I know what to look for because I have seen it. Every file I build is reviewed against the same standard the tribunal will apply, before it ever reaches them. That is what preparation looks like when the stakes are this high.

Refugee Claims FAQ

What is the Basis of Claim and why does it matter?
The Basis of Claim is a written narrative describing why you fear returning to your country and what happened to you. It is the foundation of your entire refugee claim. The RPD member reads it before your hearing and uses it to structure every question they ask you. A strong BOC gives you the best possible starting point.
How long do I have to file after making a claim?
You typically have 15 days to file your Basis of Claim if you made your claim inland, and 15 days after your eligibility interview if you claimed at the border. Extensions can be requested but are not guaranteed. The sooner you begin, the better your submission will be.
Will my personal information stay private?
Yes. Everything you share during our consultations is strictly confidential. Refugee hearings are also held in private, not in open court. Your identity and information are protected throughout the process.
What grounds qualify for refugee protection?
Canada offers refugee protection based on a well-founded fear of persecution due to race, religion, nationality, political opinion, or membership in a particular social group, as well as to persons at risk of torture or cruel and unusual treatment. We assess your specific circumstances during the consultation.
What happens if my refugee claim is denied?
A denied claim can be appealed to the Refugee Appeal Division within 15 days of the decision. If the RAD also denies the claim, there may be options for Federal Court judicial review or an H&C application. We discuss all available next steps during your consultation.
Can I work while my refugee claim is being processed?
In most cases, yes. Most refugee claimants are eligible for a work permit once their eligibility has been confirmed. We can advise you on how to apply for your work permit at the same time we prepare your refugee claim submission.
